Refund of PLA balance, Central Excise

can we claim refund of PLA balance without Surrendering the Registration Certificate and under which Rules/Act as my production is suspended from last 12 months but we are not willing to surrender the R.C

You surrender the registration or not, you can claim refund of balance amount in PLA since you have suspended the manufacturing activities. It is advisable that you should file the refund claim before surrender or simultaneously at the time of surrender. Amount in PLA is being carried forward and therefore, the period of limitation of one year is not applicable since it is not attained the nature of duty paid.
